This user agreement (“Agreement”) is an agreement between you and Health tech Products And Services Private Limited governing your use of Wellness products, software and/or services with the characteristics and features as described on website and the Wellness mobile App (“App”) and your use of the Eat Better marketplace made available on the Website and App (“Marketplace”) (referred to collectively as the "Services").You acknowledge and agree that the Subsidiaries and Affiliates will be entitled to provide the Services to you under the terms of this Agreement.

By accessing the Website, the App or the Marketplace, at your option, registering thereon and thereafter using the Services as a member or guest, you agree to be bound by this Agreement and the terms contained in it. This Agreement governs your access and use of this Website/ App/Marketplace and applies to all visitors, users and others who access the Service ("Users"). If you do not agree with the terms contained in this Agreement, you are not permitted to use this Website/ App/Marketplace. Wellness will not be liable for any consequences arising from your unauthorized use.

    Data Collection: What Information We Gather from Users and How It Is Utilized?

    Since Bien App is a healthcare platform, we need a proper health analysis and treatment history of our users so that user need to upload the document as images and pdf documents. We are asking some questions to the users as Wellbeing quiz and users need to answer to the questions for getting the real time health status. All the data’s and information collected with the consent from the user that will be handled securely and confidentially adhering to the security practices. We will endeavor to take all reasonable and appropriate steps to keep secure any information which we hold about you and prevent unauthorized access

    We implement technical and organizational safeguards to protect against the information collected from the user and will not disclose to any Third parties and will not use in any manner. Based on the applicable laws of our country, user may have the right to request access to the personal information we collect from you, change that information, or delete it based on the circumstances.

    The data collected from users is only used for their healthcare assessment and giving proper services to the user. We hold the sincere belief that you should always know what data we collect from you, the purposes for which such data is used, and that you should have the ability to make informed decisions about what data you want to share with us.

    All the statements in this Privacy Policy apply to all Practitioners, and all Practitioners are therefore required to read and understand the privacy statements set out herein prior to submitting any Personal Information or Sensitive Personal Data or Information to Bien, failing which they are required to leave the Services immediately.

    Information you provide to us:

    We receive and store any information you knowingly provide to us, including:

    1.Personal information collected at the time of your registration on the Mobile App/website, including your name, username, email address, gender, birth date, height, location;

    2.Personal information and SPDI (where necessary) collected for provision of the Services on the Mobile App/website, including your nutrition data, passwords, workout related data (including outputs from your device camera for “live energy” tracking or conducting live workout sessions), physical activity, sleep habits; and other sleep, activity, or health-related information and insights for our Services and Products;

    3.Details about your health, mental wellbeing, disabilities or other health related information such as vaccination status, past medical history, all collected for the safety of our other users and premises that they access, the discharge our duties as an employer, or to provide certain benefits;

    4.Information relating to your access and usage of premises, and sessions, including workouts, number of activities and users, data collected at our reception desks.

    5.Images and Documents- Since Bien App is a healthcare platform, we require accurate health and treatment analysis of our users. To do this, users must upload documents in PDF format or as images in order to analyse the patient's current health status.

    The information collected from you as set-out above constitutes ‘personal information’ or ‘sensitive personal data or information’ (“SPDI Rules”) in terms of the SPDI Rules. You hereby consent to collection of such information.You can choose not to provide us with certain information, but then you may not be able to register with us or to take advantage of some of our features / Products.

    Information collected automatically:

    Whenever you interact with our Mobile App, we automatically receive and record information on our server logs from your browser including your IP address, 'cookie' information, and the page you requested. 'Cookies' are identifiers we transfer to your computer or mobile device that allow us to recognize your browser or mobile device and tell us how and when pages in our Mobile App are visited and by how many people. You may be able to change the preferences on your browser or mobile device to prevent or limit your computer or device's acceptance of cookies, but this may prevent you from taking advantage of our Mobile App's best features.

Also, we may receive confirmation when you open an email from us. This confirmation helps us make emails more interesting and improve our service.     What choices do I have?

    You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our special features / Products. We will retain Your personal information for a reasonable period or as long as the law requires. If you’d like us to delete/modify Information that you have provided via the Mobile App or otherwise to us, please contact us at support@bienapp.in. Please note that some or all of the Information provided by You to us may be required in order for the Mobile App / Products to function properly.

    You may be able to add, update, or delete information as explained in section above.When you update information, however, we may maintain a copy of the unrevised information in our records. Please note that some information may remain in our private records after your deletion of such information from your account. We may use (or transfer to our affiliates, group entities or authorized third parties any aggregated data derived from or incorporating your personal information after you update or delete it, but not in a manner that would identify you personally.
